Eisai Says Sanofi Misled Court In Feud Over Deposition Docs

Law360, New York (March 16, 2012, 8:06 PM EDT) -- Japanese pharmaceutical company Eisai Inc. lodged an appeal Friday of a magistrate judge’s ruling that it couldn't make Sanofi-Aventis US LLC produce deposition transcripts from a 2003 antitrust suit, arguing Sanofi misled the court by claiming the old suit involved different parties and another drug, contract and market.

The drugmaker claims one of the most promising areas for discovery in its current suit is the 2003 antitrust action between Sanofi’s corporate predecessors Aventis Pharma Ltd. and Organon Sanofi Synthelabo LLC.
