Industry Group Shut Out From Pulp Mill Regs Suit

Law360, New York (March 19, 2012, 4:58 PM EDT) -- The American Forest & Paper Association Inc. cannot challenge a lawsuit in which environmental groups demand a U.S. Environmental Protection Agency review of decades-old emissions standards for kraft pulp mills, a California federal judge ruled Friday.

The Center for Biological Diversity, Greenpeace and Port Townsend AirWatchers claim in the suit that the EPA neglected a Clean Air Act duty to review new source performance standards for the mills at least every eight years. According to the plaintiffs, the EPA performed its last review in 1986....
