Calif. High Court Nixes Permit For PG&E Power Plant

Law360, New York (March 19, 2012, 8:51 PM EDT) -- A California appeals court on Friday nullified a decision by the state's Public Utilities Commission to approve construction of a 586-megawatt Pacific Gas and Electric Co. renewable energy project near Sacramento, saying the commission failed to follow its procedures in awarding approval.

In an unpublished opinion, a three-judge panel reversed the commission's approval of the project after nonprofit group The Utility Reform Network alleged the agency failed to properly notify all parties of the determination or allow a meaningful opportunity for public comment and evidentiary hearings....
