Scotts Ad's Fertilizer Claims Are Bull, Rival Says

Law360, New York (March 20, 2012, 5:17 PM EDT) -- Grass seed and fertilizer company Pennington Seed Inc. on Friday sued rival The Scotts Miracle-Gro Co. in federal court for false advertising and unfair competition law violations over Scotts' commercials that compare its grass fertilizer product to Pennington’s.

Georgia-based Pennington alleges a Scotts’ television commercial makes false and misleading claims that Pennington’s 1 Step Complete fertilizer is composed entirely of "ground up paper," implying that Scotts’ EZ Seed fertilizer product is superior.
