High Court Defends Fair Trial Protections For Plea Deals

Law360, New York (March 21, 2012, 1:49 PM EDT) -- The U.S. Supreme Court ruled Wednesday that the Constitution’s guarantee of a fair trial extends to plea bargains, overturning a pair of lower court rulings that said the defendants' rights were not violated when they received bad advice from their lawyers on plea bargains.

In the first case, the high court ruled 5-4 that ineffective counsel leading to the expiration of a plea bargain offered to Gail Frye, who was charged with driving with a revoked license, may have violated his rights.
