Judge Won't Let Caterpillar Engine Defect Class Emerge

Law360, New York (March 22, 2012, 12:51 PM EDT) -- A South Carolina federal judge on Wednesday declined to certify a class of truck purchasers in a suit against Caterpillar Inc. over allegedly defective engines, ruling that plaintiff Robert Elliott Trucking Inc. failed to identify a specific defect.
