De Beers Antitrust Ruling Bucks Dukes, High Court Told

Law360, New York (March 22, 2012, 6:53 PM EDT) -- Two disaffected diamond purchasers told the U.S. Supreme Court earlier in March that the Third Circuit's decision upholding a $295 nationwide antitrust settlement with De Beers SA contradicts the high court's Dukes decision and rulings about equity among class members.

The plaintiffs, two of several who had objected to the settlement in the New Jersey district court then pursued the case to the Third Circuit, on March 8 lodged a petition for certiorari with the high court, renewing their claim that the deal improperly distributed funds...
