Insurer Can Leave Steelers Shirtmaker Uncovered In IP Scrum

Law360, New York (March 23, 2012, 12:21 PM EDT) -- American Economy Insurance Co. does not have to cover a Pennsylvania T-shirt maker who lost a suit alleging his "Terrible T-shirt" infringed the famous Pittsburgh Steelers Terrible Towel trademark, a federal judge ruled Friday.

U.S. District Judge Arthur J. Schwab entered a default judgment against Eugene Berry Enterprises LLC in a declaratory suit by the Steelers and the Allegheny Valley School Foundation, a nonprofit facility that houses mentally disabled residents and owns the Terrible Towel mark.
