Fed. Circ. Revives Challenge To Brazilian Juice Duties

Law360, New York (March 23, 2012, 8:06 PM EDT) -- The Federal Circuit revived Fischer SA Comercio Industria and Agricultura's challenge to anti-dumping duties on certain Brazilian orange juice Friday, holding that the U.S. Department of Commerce should have accepted additional evidence on Fischer's home market prices.

A three-judge panel ruled 2-1, vacating a judgment from the Court of International Trade and and remanding the matter with instructions for Commerce to consider evidence from Fischer that it had previously refused to accept and recalculate the anti-dumping duty if necessary.
