Court Greenlights FLSA Suit Against Wachovia

Law360, New York (August 13, 2007, 12:00 AM EDT) -- A California appellate court agreed with a state trial court Friday, ruling that class action wage-and-hour claims brought against Wachovia Securities LLC could be litigated before the lower court.

The Court of Appeal of the State of California, Second Appellate District ruled on the complicated case, after class action claims filed by former Wachovia employee Jason Clark were bounced from trial court to arbitration and back at the request of the financial services company.
