7th Circ. Affirms Class Cert. Denial In Allstate Bias Case

Law360, New York (March 27, 2012, 5:17 PM EDT) -- The Seventh Circuit on Tuesday upheld a lower court's denial of certification for a group of female Allstate Insurance Co. employees alleging gender-based pay discrimination, saying the class members were barred from raising arguments in their appeal that were absent from the original case.

The appellate court affirmed the lower court's decision denying class certification to the group that had taken over the case from the original plaintiff, ruling that the managers' claim of disparate impact against the insurer hadn't been sufficiently argued in the complaint...
