Omni's Fraud Claims Tossed Over Supplier's Defective Seals

Law360, New York (March 27, 2012, 9:24 PM EDT) -- A Texas federal judge on Tuesday tossed agricultural machinery component supplier Omni USA Inc.’s fraud claims against an industrial oil seal manufacturer that it had accused of selling defective seals for Omni’s gearboxes meant for use in irrigation systems.

U.S. District Judge Melinda Harmon partially dismissed Omni’s suit against Parker-Hannifin Corp. without prejudice, finding that Omni had not adequately supported its claims that Parker’s representatives knowingly had misrepresented the quality of their seals before Omni’s purchase.
