2nd Circ. OKs $3M Award To Louis Vuitton For Knockoffs

Law360, New York (March 29, 2012, 5:11 PM EDT) -- The Second Circuit on Thursday upheld a $3 million damages award in favor of Louis Vuitton Malletier SA against convicted counterfeiters, finding knockoffs only had to be confusingly similar, not exact replicas, to constitute trademark infringement. 

The appeals court affirmed a New York federal judge’s decision to award summary judgment, damages and attorneys’ fees to Louis Vuitton after siding with the designer in its trademark infringement lawsuit against Coco, LY USA Inc. and Marco Leather Goods Ltd, as well as individuals Joyce Chan and Chong Lam....
