High Court Wants US View In Monsanto Seed Patent Case

Law360, New York (April 2, 2012, 4:51 PM EDT) -- The U.S. Supreme Court on Monday asked the U.S. solicitor general to weigh in on a patent case involving Monsanto Co.'s patents for Roundup Ready soybean seeds in which a lower court rejected an accused infringer's argument that the company's patent rights were exhausted.

The high court invited Solicitor General Donald Verrilli Jr. to express the views of the federal government in the case, which hinges on the application of the patent exhaustion doctrine in the context of self-replicating technologies like genetically modified seeds.
