3rd Circ. Lets Insurers Pass The Bill For Catheter-Slur Defense

Law360, New York (April 2, 2012, 7:27 PM EDT) -- The Third Circuit ruled Monday that Liberty Mutual Insurance Co. and other insurers don't have to cover part of medical device maker C. R. Bard Inc.'s $49 million settlement of a disparagement and antitrust suit brought by rival Rochester Medical Corp.

Policies from Liberty Mutual, Lexington Insurance Co. and American International Specialty Lines Insurance Co. all exclude claims for disparaging materials first published before the policies went into effect, and Rochester's disparagement claims all stem from statements about its antimicrobial catheters that Bard began to make...
