9th Circ. Won't Rethink Win For Thorpe's Ch. 11 Foes

Law360, New York (April 3, 2012, 6:26 PM EDT) -- The Ninth Circuit on Tuesday refused to reconsider its finding that a group of insurance companies that hadn't yet settled asbestos claims with Thorpe Insulation Co. could challenge the insulation installer's reorganization plan.

The appeals court said U.S. Circuit Judge Ronald M. Gould, who wrote the Jan. 24 decision on behalf of a three-judge panel, had voted to deny Thorpe’s Feb. 7 petition for rehearing en banc, according to an order Tuesday.
