ERISA Plans Must Pay Accrued Benefits To All: Court

Law360, New York (August 16, 2007, 12:00 AM EDT) -- An appellate court has agreed with a lower court’s ruling that ERISA pension plans should provide accrued cost-of-living adjustments to retired employees who received lump sum distributions if the same benefits are provided to retirees who receive monthly payments.

The U.S. Court of Appeals for the Seventh Circuit on Tuesday upheld the district court’s decision granting class certification and summary judgment to an employee who filed suit against Rohm and Haas Co.’s pension plan alleging violations of ERISA.
