Judge Deals Blow To Wells Fargo In Overtime Case

Law360 (August 16, 2007, 12:00 AM EDT) -- A federal judge presiding over the overtime pay multidistrict litigation against Wells Fargo & Co.’s home mortgage unit has refused to dismiss, under California law, claims of unfair competition brought on behalf of mortgage consultants residing in other states.

Judge Marilyn Hall Patel determined on Monday in the U.S. District Court for the Northern District of California that the decision to continue classifying the company’s mortgage consultants as exempt was made in California and could have affected non-California mortgage consultants.
