Kroger Hit With Trademark Suit Over 'Chipotle' Chicken

Law360, New York (April 9, 2012, 2:08 PM EDT) -- Chipotle Mexican Grill Inc. filed a trademark infringement suit against grocery retailer The Kroger Co. in Colorado on Friday, accusing Kroger of trying to piggyback on the restaurant chain's goodwill and reputation by putting the term "chipotle" on its chicken products.

Chipotle, which owns and operates over 1,250 restaurants in the U.S., said that it had invested substantial time and effort into creating and maintaining the goodwill of its brand, and held several trademark and and service mark registrations covering the word "chipotle."
