Illinois National Appeals $2M Excess Trigger To 5th Circ.

Law360, New York (April 9, 2012, 5:46 PM EDT) -- Illinois National Insurance Co. on Monday filed a notice of appeal to the Fifth Circuit of a finding that its excess insurance policy kicks in after another insurer spends $2 million to settle lawsuits alleging their insured's faulty highway construction caused car accidents.

Illinois National has insisted that Twin City Fire Insurance Co. should have to shell out the aggregate $4 million limit on its policy, but a Texas federal court found to the contrary.
