Calif. County Can't Sue DOI Over Colo. River Water Plan

Law360, New York (April 11, 2012, 3:07 PM EDT) -- A federal judge ruled Friday that a California county does not have standing to sue the U.S. Department of Interior over the distribution of Colorado River water, saying the environmental injuries it alleges do not form a basis to sue the federal government.

The plaintiffs, Imperial County and the Imperial County Air Pollution Control District, had argued that the Interior Department violated the Clean Air Act and the National Environmental Policy Act when it approved the Colorado River Water Delivery Agreement in 2003.
