FDA Overstepped In Pet Drug Case, Groups Tell 11th Circ.

Law360, New York (April 12, 2012, 8:35 PM EDT) -- Two organizations urged the Eleventh Circuit on Wednesday to uphold a Florida court’s ruling that the U.S. Food and Drug administration overstepped its authority when it tried to stop a Florida compounder from mixing prescription drugs for animals.

The Washington Legal Foundation and the Society of Veterinary Hospital Pharmacists filed amicus briefs saying the FDA has misconstrued its authority over Franck's Lab Inc. and that the long-standing practice of compounding — mixing bulk drug ingredients into custom medications at the request of veterinarians — has been...
