House Panel Would Overhaul U.S. Patent System

Law360 (April 17, 2005, 12:00 AM EDT) -- A committee of the U.S. House of Representatives has drafted a proposal for a radical overhaul of U.S. patent law, including the establishment of post-grant opposition procedures and the abolition of increased damages based on willful infringement.

The draft of the Patent Act of 2005, a copy of which was obtained by intellectual property attorney Dennis Crouch at his blog (www.patently-o.com), is seen as a precursor to a bill that will be introduced in the House in the coming days.
