Shaw, GenOn Lose SJ Bids In $1B Power Plant Contract Suit

Law360, New York (April 19, 2012, 3:23 PM EDT) -- Shaw Group Inc.'s claims that it is owed $1.1 billion by two GenOn Energy Inc. units for a contract to install pollution control equipment on three power plants remained alive Wednesday when a New York federal judge mostly denied competing summary judgment bids.

In mostly denying GenOn's partial bid for summary judgment, U.S. Judge Harold Baer Jr. ruled that "issues of fact abound" over whether Shaw satisfied the conditions for payment on the contract, which GenOn had argued Shaw had not. Judge Baer also completely rejected...
