MedPointe Sues Generics Maker Over Allergy Spray

Law360 (August 23, 2007, 12:00 AM EDT) -- MedPointe Healthcare Inc. on Wednesday filed a patent infringement suit against Cobalt Pharmaceuticals Inc. in an attempt to stop the Canadian drug company from making a generic version of its anti-allergy medication.

The suit centers on U.S. Patent Number 5,164,194, issued in November 1992 and entitled “aAelastine containing medicaments.” MedPointe has owned the patent, which is slated to expire in 2011, since August 2002.
