ArvinMeritor Loses Appeal Of $4.5M Asbestos Ruling

Law360, New York (April 20, 2012, 2:38 PM EDT) -- A California appeals court on Thursday upheld a jury's $4.5 million punitive damages award against ArvinMeritor Inc. in a lawsuit blaming the company's asbestos-containing brake shoes for a now-deceased auto maintenance worker's mesothelioma.

ArvinMeritor, now known as just Meritor, unsuccessfully argued that California law limits punitive damages to 10 percent of defendant's net worth, which in ArvinMeritor's case was about negative $1 billion, according to the ruling.
