Merck Escapes High Court Hearing In $26M Vioxx Suit

Law360, New York (April 23, 2012, 2:45 PM EDT) -- The U.S. Supreme Court declined Monday to consider whether a Texas appeals court erred in tossing a $26.1 million Vioxx liability verdict against Merck & Co. Inc., allowing the pharmaceutical giant to walk away without owing anything to a woman who blamed the company for her husband's death.

Carol Ernst initially won a landmark $253 million verdict for the 2001 death of Robert Ernst, her husband, who died less than a year after taking Vioxx for tendonitis pain. That verdict was later cut down to $26.1...
