Restaurant Worker Was Harassed Via Facebook, NLRB Rules

Law360, New York (April 24, 2012, 5:13 PM EDT) -- A National Labor Relations Board judge on Friday ruled that a Facebook posting by an assistant manager of a sandwich chain urging others to text a pro-union employee constituted harassment, but held that other disparaging comments were protected under the National Labor Relations Act.

Administrative Law Judge Arthur J. Amchan made the ruling concerning unionization efforts at Miklin Enterprises Inc., a corporation which operates 10 Jimmy John’s sandwich shops in the Minneapolis-St. Paul area as a franchisee.
