Plaintiff Gets Second Chance Against Intel

Law360 (August 27, 2007, 12:00 AM EDT) -- An appellate court has rebuked a district court for holding a bench trial on patent inventorship before a jury trial on related state law claims of fraud against Intel Corp. could proceed, arguing it violated the plaintiff's right to a jury trial.

A three-judge panel of the U.S. Court of Appeals for the Federal Circuit vacated the district court's finding of inventorship on Thursday for Jean-Marc Verdiell, whose company's purchase by Intel prompted a lawsuit from Verdiell's former business partner Frank T. Shum.
