High Court Asked To Review Antitrust Standing Rule

Law360, New York (April 26, 2012, 8:17 PM EDT) -- SigmaPharm Inc. asked the U.S. Supreme Court last week to consider whether some of the circuits have improperly created a rule that only consumers and competitors involved in a market affected by anti-competitive behavior have standing to sue under U.S. antitrust law.

In a petition for a writ of certiorari filed April 20, the generic drug developer urged the justices to review a Third Circuit decision upholding the dismissal of its antitrust and contract suit against Mutual Pharmaceutical Co. Inc. and King Pharmaceuticals Inc. over royalties...
