Judge Says Concepcion Kills Murphy Oil FLSA Case

Law360, New York (April 30, 2012, 6:02 PM EDT) -- An Alabama federal magistrate judge said Thursday that the U.S. Supreme Court's landmark AT&T Mobility LLC v. Concepcion ruling should force four Murphy Oil USA Inc. workers to individually arbitrate their allegations that the fuel company denied them overtime.

The Murphy Oil gas station cashiers conceded that they had signed binding arbitration agreements, but had argued that a provision barring them from proceeding as a class made the contracts unenforceable.
