Ink-Stick Maker Drops Counterclaims Against Xerox

Law360 (August 28, 2007, 12:00 AM EDT) -- An ink cartridge company accused of infringing four Xerox Corp. patents has agreed to drop counterclaims that the patents are unenforceable and that the Xerox engaged in unfair competition.

Media Sciences International and Xerox asked a New York federal court on Monday to dismiss the counterclaims with prejudice, with each party to bear its own costs and attorneys' fees regarding the dismissed counterclaims. Media Sciences' patent invalidity and breach of contract claims, as well as Xerox's patent infringement claims, remain intact.
