Fed. Circ. Bats Down Essar In Steel Products Duty Row

Law360, New York (April 27, 2012, 8:55 PM EDT) -- The Federal Circuit on Friday ruled that Essar Steel Ltd. had received countervailable subsidies from the Indian government, reversing one prong of a U.S. Court of International Trade decision and affirming another in a duty dispute between the steelmaker and the U.S. government.

In a precedential ruling, the appeals court affirmed the CIT's decision that Essar had received subsidies through its iron ore purchases and use of certain government programs, denying Essar's bid to overturn that decision. It also granted a cross-appeal by United States Steel...
