Insurer Can't Stop Benefits While 11th Circ. Hears Suit

Law360, New York (April 27, 2012, 4:10 PM EDT) -- A Florida federal judge on Friday denied a request by Washington National Insurance Corp. to lift an injunction requiring it to pay home health care benefits while the 11th Circuit weighs in on the company's loss of a key summary judgment ruling in the class action.

Washington National had argued that the injunction should be stayed until the 11th Circuit rules on the case, claiming it was likely to prevail on appeal because the appellate court had asked the Florida Supreme Court to answer a question...
