Genzyme Irons Out FCA Suits Over Surgery Product Marketing

Law360, New York (May 3, 2012, 7:40 PM EDT) -- A Florida federal judge on Thursday tossed two whistleblower False Claims Act suits brought by former Genzyme Corp. employees and a doctor accusing the company of improperly marketing its Seprafilm adhesion barrier, after the federal government said the parties had reached a proposed settlement.

The federal government, which partially intervened in the suits, told the court Tuesday that U.S. Department of Justice authorities still needed to approve the agreement. In dismissing the suits, U.S. District Judge Steven D. Merryday said any party could reopen the litigation...
