CVS Pharmacies Battle Controlled Drugs Sales Ban In DC Circ.

Law360, New York (May 7, 2012, 7:50 PM EDT) -- Two CVS Caremark Corp. pharmacies on Friday challenged the D.C. Circuit's decision to maintain the U.S. Drug Enforcement Administration’s ban prohibiting them from selling controlled substances after the agency accused them of filling suspicious orders for painkiller oxycodone.

In a brief, the two Florida pharmacies argued that the DEA had been “arbitrary and capricious” in issuing immediate suspension orders without a hearing, which they stated was an extreme measure reserved only for emergency situations, which did not apply in this case.
