E-Z-EM Fights Back Against Tyco Patent Suit

Law360 (August 31, 2007, 12:00 AM EDT) -- Medical product maker E-Z-EM has filed an answer and counterclaim in response to Tyco Healthcare Group LP’s recent patent suit, calling the patent-in-suit invalid and asking the court to dismiss Tyco and its subsidiary Mallinckrodt Inc. from the case.

In a motion filed Thursday in the U.S. District Court for the Eastern District of Texas, E-Z-EM claimed that the patent-in-suit, owned by Mallinckrodt subsidiary Liebel-Flarsheim Co., is invalid.
