BNSF Pays $36M To Settle Mont. Rail Yard Pollution Suit

Law360, New York (May 9, 2012, 8:59 PM EDT) -- BNSF Railway Co. on Tuesday resolved claims that its rail yard near Livingston, Mont., caused pollution to seep into private properties and destroy property values, after the city commission agreed to accept the company's $36 million settlement.

Of that amount, $16 million will be designated for trust for cleanup efforts that will be administered by the landowners who appeared as plaintiffs alongside the city, and the other $20 million will be dispersed among the landowners for damages to property value and use of their property, City...
