Cell Number Transfer Ends Robocall Consent: 7th Circ.

Law360, New York (May 11, 2012, 7:19 PM EDT) -- The Seventh Circuit on Friday clarified that the Telephone Consumer Protection Act requires consent from current cellphone owners before they can be autodialed, siding against a debt collector facing a putative class action over robocalls allegedly made to the wrong recipients.

Enhanced Recovery Co. LLC, a debt collector hired by AT&T, unsuccessfully argued that debtors' consent to be called on their cellphones remained in force even if their numbers were later reassigned to other people.
