Law360, New York (May 21, 2012, 1:13 PM EDT) -- In 2008, Congress instructed the U.S. Department of Defense to consider the use of DOD civilian employees to perform DOD functions.[1] The amendments to 10 U.S.C. § 2463 provided that “special consideration” should be given to use DOD civilian personnel to perform functions. The amendments also included a requirement that the DOD create guidelines and procedures to ensure consideration is given to using DOD civilians for new functions and functions currently performed by contractors.
