De Beers Tells 2nd Circ. Antitrust Suit Is Too Late, Vague

Law360, New York (May 17, 2012, 8:45 PM EDT) -- A subsidiary of the De Beers Family of Cos. on Tuesday told the Second Circuit that a bankrupt diamond seller’s bid to revive an antitrust suit should be denied, saying the seller’s claims are untimely and vague.

Diamond Trading Co. Ltd. argued in its appellate brief that former New York diamond seller W.B. David & Co. Inc. committed a fatal procedural error when it abandoned claims that it was terminated as a supplier of choice, then sought to replead those claims too late. Other claims in...
