Court Puffs New Life Into Cigarette Class Action

Law360 (September 6, 2007, 12:00 AM EDT) -- A federal appeals court panel has reinstated a class action lawsuit that accuses Philip Morris USA Inc. of marketing “light” cigarettes that actually contain the same quantities of tar and nicotine as regular cigarettes.

Philip Morris, a subsidiary of Altria Group Inc., previously won a summary judgment dismissal of the case on the grounds that the state law claims were preempted by federal law.
