Expanding DCAA Access To Contractor Records

Law360, New York (June 5, 2012, 1:21 PM EDT) -- The Defense Contract Audit Agency recently issued its annual report to Congress which included a request to expand the DCAA's subpoena authority by granting the DCAA statutory access to contractors' internal audit materials under 10 U.S.C. § 2313. This request follows a December 2011 report by the Government Accountability Office that criticized the DCAA's methods for obtaining internal audit materials from contractors. This potential expansion of the DCAA's audit power should prompt contractors to revisit their internal control policies related to internal audits and to weigh the practical considerations of withholding internal audits from, or granting access to, the DCAA....
