DOE Escapes Suit Challenging 26 Loan Guarantees

Law360, New York (May 21, 2012, 8:41 PM EDT) -- A federal judge on Thursday dismissed a suit accusing the U.S. Department of Energy of illegally issuing 26 loan guarantees to environmentally friendly projects that did not use new technology, finding that the group Californians for Renewable Energy lacked standing to bring the suit.

U.S. District Judge James E. Boasberg granted the DOE's motion to dismiss a suit alleging the agency skipped several required procedural steps when it began issuing loan guarantees for energy projects using commercially available technology as opposed to new or innovative techniques....
