Groups Say $5.6M Award Against Kia Violates Due Process

Law360, New York (May 23, 2012, 1:40 PM EDT) -- Two legal groups urged the U.S. Supreme Court in the past week to overturn a $5.6 million class action award over allegedly faulty Kia Motors America Inc. brake systems, saying Pennsylvania's highest court's use of one plaintiff's damages to calculate an aggregate award violated Kia's due process rights.

Defense bar group Defense Research Institute and pro-business legal group Washington Legal Foundation said in amicus briefs filed with the high court on May 17 and May 21, respectively, that by calculating damages against Kia Motors America Inc....
