Progressive Customers Can't Sue Atty Over Investigation Tactics

Law360, Los Angeles (May 23, 2012, 4:12 PM EDT) -- A California judge on Wednesday dismissed an attorney from a breach of contract suit alleging she conducted "inquisition-style" investigations on Progressive Choice Insurance Co.'s behalf that led the company to unfairly reject policyholders' insurance claims.

Judge Barbara M. Scheper granted Teresa M. Starinieri's motion citing California's anti-SLAPP — strategic lawsuit against public participation — statute, ruling that the private attorney could not be held individually liable for the policyholders' claims because she was working as an agent of Progressive.
