Asarco Moves To Quash Harbinger's Bid For Docs

Law360, New York (September 11, 2007, 12:00 AM EDT) -- Bankrupt copper mining company Asarco LLC wants the court overseeing its Chapter 11 case to veto a last ditch attempt by Harbinger Capital Partners to get its hands on confidential documents, saying the hedge fund should know when to quit.

In its motion Monday for an order quashing notice of intent by the bondholder to conduct a so-called Rule 2004 examination to get at Asarco's business records, the company argues Harbinger has already lost multiple bids for confidential files and must accept defeat.
