Labor Dept. Beats Trade Groups' Tip Rule Challenge

Law360, New York (May 29, 2012, 8:19 PM EDT) -- The U.S. Department of Labor on Tuesday beat claims in Washington federal court that it hadn't given a trio of trade groups enough opportunity to comment on a rule that changed requirements that forced employers to notify tipped workers about their wage rates.

U.S. District Judge Amy Berman Jackson tossed a suit by the National Restaurant Association, the Council of State Restaurant Associations Inc. and the National Federation of Independent Business, which accused the DOL of violating the Administrative Procedure Act.
