1st Circ. Finds DOMA Unconstitutional

Law360, New York (May 31, 2012, 1:04 PM EDT) -- The First Circuit on Thursday found unconstitutional a federal law that defines marriage as between a man and a woman and denies federal benefits to same-sex couples, holding that federalism bars Congress from interfering with states that opt to legalize same-sex unions.

The appeals court's ruling affirms a Massachusetts federal judge's decision that Section 3 of the Defense of Marriage Act, which denies federal economic and other benefits to same-sex couples lawfully married in the state and to surviving same-sex spouses, is unconstitutional.
