In Exelon Case, 7th Circ. Judge Questions Nuclear Security

Law360, New York (June 1, 2012, 1:33 PM EDT) -- A “strange and dangerous” legal void exists in oversight of employee security clearances at nuclear power plants, a Seventh Circuit judge said Thursday, using a dispute involving Exelon Generation Co. to call for stronger government scrutiny of access to sensitive energy facilities.

Judge Richard Posner weighed in as the appeals court refused to rehear a case where Exelon was rebuked for trying to prevent independent arbitrators from reviewing its revocation of employee access privileges.
